It also claimed that these calls violated the DNC Registry. As directed by the FCC, the Company has relied on reasonable analytics which for several years has included such tools as YouMail and TNSI reputational scoring, daily downloads of the DNC Registry and immediate action regarding any suspicious activity identified by the ITG. The call traffic in dispute occurred two years before the implementation of S\/S which XCast implemented by July 2021. The Company had terminated the relationship with the company FTC identified as the antecedent company or originator of the traffic long before the FTC dispute arose. FTC has never taken any action against the party(ies) who supposedly sent the traffic to XCast in the pre-S\/S environment. XCast settled the matter in December, 2023 with no finding of wrongdoing and no fine. The question of the legality -even the necessity--of short duration calls was finally resolved by the FCC in its 7th Order, adopted in 2023. Some of XCast's customers do rely on short duration calls in the normal course of business and their customer base includes organizations that are exempt from the DNC Registry: churches, charities, schools, political calling."}
